General information
Probate is the legal process through which a decedent’s estate is passed on to his or her beneficiaries.
If a will exists, the probate court confirms that the will is valid and hears any objections. After the decedent’s creditors are paid, the estate is distributed in accordance with the terms and conditions of the will.
If a person dies without a will, the probate court appoints someone to pay the decedent’s creditors and then distribute the remaining property. Since there is no will, this is done in accordance with the laws of intestacy.
